By using this website and/or purchasing tours from a Pennicott Wilderness Journeys office and/or participating in a tour operated by Pennicott Wilderness Journeys, you agree to the following Terms & Conditions.

1. Copyright & Terms of Use

Copyright © 2023 Pennicott Wilderness Journeys Pty Ltd (ACN 114 449 348) and Wilsons Promontory Cruises Pty Ltd (ACN 626 364 592) collectively referred to in these terms and conditions as 'Pennicott Wilderness Journeys'.

The following information applies to:

  • the Pennicott Wilderness Journeys website (www.pennicottjourneys.com.au) as well as the subsidiary websites for Bruny Island Cruises, Tasman Island Cruises, Bruny Island Traveller, Iron Pot Cruises, Tasmanian Seafood Seduction, Wineglass Bay Cruises and Wilsons Promontory Cruises.
  • Pennicott Wilderness Journeys' offices; and
  • all persons participating in a tour operated by Pennicott Wilderness Journeys.

Our website, its content, text, images and associated material is owned and copyrighted by Pennicott Wilderness Journeys. By accessing and the website, you agree to be bound by these terms of use. Pennicott Wilderness Journeys reserves the right to change these terms and conditions from time to time at its sole discretion.

You are permitted to view, copy, print and distribute the information contained in our website for personal, non-commercial purposes subject to your agreement that you will not modify the information or graphics and you will display the copyright notice on all information.

Printing or distributing the information contained in this website for commercial purposes is strictly forbidden without prior written consent, which can be obtained by email marketing@pennicottjourneys.com.au.

Our website may contain links to third party websites which are not under the control of Pennicott Wilderness Journeys. A link to another website should not be taken as our endorsement of the content as we are not responsible for the content of any third party websites. 

 

2. Privacy Policy

Pennicott Wilderness Journeys respects and protects the privacy of our guests and visitors to our website, our offices and our tours.

All information collected is processed in accordance with the National Privacy Principles, established under the Privacy Act 1988. The information provided by you when you make a booking or make an enquiry through our website ("Personal Information") and any other information sent to us by you or otherwise obtained by us about you is only used for the purposes of responding to your enquiry; processing your booking; providing a personalised service; providing you with goods and services you have requested; fulfilling our obligations under law; assisting and evaluating how visitors use the website.

Although Pennicott Wilderness Journeys may share general information about our website visitors and guests with third parties, this data is collated into aggregate measures and contains no details which could identify specific individuals. For example we use Google Analytics to report on statistical information about our website visitors including time spent on website, the pages viewed, location, technology, demographics but this does not contain any personally identifiable information.

If you travel on one of our tours or make a payment to us, we are required by law to keep a record of passenger details and financial transactions. You can be assured that individually identifiable information is not disclosed to any third party for any purpose other than dealing with a purchase or enquiry from you, or fulfilling our obligations under law.

3. Pricing Currency & GST

All prices are in Australian Dollars (AUD) and include GST and may change from time to time.

 

4. Bookings are Subject to Availability

Tour schedules may change from time to time, places are limited on our tours and all bookings are subject to availability.  

 

5. Cancellation Policy

You are on holiday and we want your travel plans to be flexible. However our tours are often fully booked and we may have a waiting list for guests interested in coming along. Therefore if you are running late or you decide not to join a tour, we would appreciate it if you please contact us by calling (03) 6234 4270 to cancel your booking. This gives us an opportunity to re-sell your seats to other guests.

Our standard cancellation policy is that 100% fee will be charged for cancellations within 24 hours of a tour. Alternative cancellation policies may apply to certain bookings and we will advise you if this applies.

 

6. Variation of Tours

We reserve the right to cancel or vary any trip and will incur no liability for any such cancellation or alteration.   

 

7. Product Refund Policy

If you purchase clothing, souvenirs, soft toys, jewellery or other retail merchandise from our giftshop, we are not required to provide a refund or replacement if you change your mind. However in the event of a fault with an item, we will either exchange, refund or replace the item in accordance with the requirements of the Australian Consumer Law. Please keep your proof of purchase (eg a receipt).

Please note that gift vouchers cannot be refunded or redeemed for cash. Lost gift vouchers cannot be reissued or replaced.

 

8. Delivery Policy

Where you purchase goods that require delivery, any costs associated with delivery will be stated before the transaction is finalised and payment is processed. Depending on the cost of your order sometimes there may be an additional charge and if this is the case, we will let you know as soon as possible. Where the delivery cost is more than we originally told you, you have the opportunity to pay the new cost or cancel your order.

 

9. Land Based Tours and Bus Transfers

Pennicott Wilderness Journeys provide seabound tours, land based tours, bus services and bus transfers.

Pennicott Wilderness Journeys' buses/vehicles are operated under the absolute direction and control of Pennicott Wilderness Journeys driver at all times.

By boarding Pennicott Wilderness Journeys' bus/vehicle, you agree to comply with all reasonable requests made by Pennicott Wilderness Journeys and/or the driver, at all times.

All passengers must comply with these terms and conditions and obey any reasonable request of the Pennicott Wilderness Journeys and/or the driver.

Offensive behaviour during a tour (including when on the bus and at all other times during the tour) will not be tolerated, including any conduct that is a nuisance, dangerous activity or offensive in any way that interrupts the enjoyment of the experience for other persons. If a passenger behaves in a way that negatively impacts others, Pennicott Wilderness Journeys reserves the right to take all reasonable steps to remove the offending passenger from our bus/vehicle/tour at their expense, notify the relevant authorities and may record the offending passenger’s details on our Incident Register

 

10. The Master

Pennicott Wilderness Journeys' vessels are operated under the absolute direction and control of the Master at all times.

The Master of the vessel has the sole and absolute discretion to vary the scheduled route or destination of the tour if for any reason the Master considers it necessary for the safety and welfare of the vessel, its passengers and crew.

By boarding Pennicott Wilderness Journeys' vessel, you agree to comply with all reasonable requests made by Pennicott Wilderness Journeys and/or the Master of the vessel, at all times.

 

11. Passenger Conduct While Aboard

Pennicott Wilderness Journeys are committed to the safety and wellbeing of all passengers, crew, and other personnel on board our vessel. All passengers must comply with these terms and conditions and obey any reasonable request of the Master of the vessel and any member of the crew.

Offensive behaviour will not be tolerated. This includes conduct that is a nuisance, dangerous activity or offensive in any way that interrupts the enjoyment of the experience for other persons. If a passenger behaves in a way that negatively impacts others, Pennicott Wilderness Journeys reserves the right to take all reasonable steps to remove the offending passenger from our vessel at their expense, notify the relevant authorities to receive the offending passenger onshore to be dealt with accordingly and may record the offending passenger’s details on our Incident Register.

 

12. Risk - Liability for Personal Injury or Loss or Damage to Property

Pennicott Wilderness Journeys and its owner, director, management staff and employees shall not be held responsible for any injury or death to persons on tours, or for loss or for any damage to personal property, howsoever occurring.

Pennicott Wilderness Journeys draws your attention to the fact that there are certain inherent health as well a physical risks present when on tour, as our vessels travel to open waters. If Pennicott Wilderness Journeys advise you of a risk and/or instruct you on precautionary measures while on tour, you agree to follow those instructions.

All personal belongings will be your responsibility. Where consumer laws and other laws permits Pennicott Wilderness Journeys' to exclude its liability, we will not be liable for:

12.1 Loss of, or damage to, any luggage, property or other belongings;

12.2 Sickness, injury or death occurring during embarkation and/or disembarkation to or from the vessel and/or at any time whilst aboard the vessel itself, unless caused by wilful misconduct or reckless disregard by Pennicott Wilderness Journeys. You agree to release Pennicott Wilderness Journeys, its crew and personnel from any claim and liability incurred, howsoever occurring;

12.3 Sickness, injury or death occurring during boarding and/or alighting from a bus/vehicle and/or at any time whilst aboard the bus/vehicle itself and/or during the course of a tour, unless caused by wilful misconduct or reckless disregard by Pennicott Wilderness Journeys. You agree to release Pennicott Wilderness Journeys, its drivers and personnel from any claim and liability incurred, howsoever occurring.

In the unlikely event of an incident occurring during the course of carriage resulting in personal injury or loss or damage due to the perceived negligence of Pennicott Wilderness Journeys, you will be responsible to prove that your personal injury or loss or damage was the fault of Pennicott Wilderness Journeys or its personnel.

By agreeing to these terms and conditions, you are certifying that you are medically and physically fit and able to participate in Pennicott Wilderness Journeys' tours and that you will not participate under influence of any illicit drugs, or any prescription medication which would in any way impair your ability to safely participate.

 

13. Photography / Video

By participating in a tour operated by Pennicott Wilderness Journeys, you acknowledge that your image may be caught by cameras controlled by Pennicott Wilderness Journeys or other passengers, be that photographic or video, which may be used in promotional material or shared across social media. By participating in a tour operated by Pennicott Wilderness Journeys, you agree that your image may be shared on social media or other platforms and release Pennicott Wilderness Journeys from any liability in relation to the sharing of those photographs / videos.

 

14. Complaints

If you have any complaints, please let us know by contacting Pennicott Wilderness Journeys by phone (03) 6234 4270 or email info@pennicottjourneys.com.au. We welcome your feedback as an opportunity to improve our business, customer service and overall experience.

We aim to do our best to resolve your complaint by the end of the third business day after the day we receive it (excluding weekends).

 

15. Jurisdiction

Any dispute or claim arising out of or in connection with any tour operated by Pennicott Wilderness Journeys and conducted in Tasmania shall be governed and construed in accordance with the laws of Tasmania.

Any dispute or claim arising out of or in connection with any tour operated by Pennicott Wilderness Journeys and conducted in Victoria shall be governed and construed in accordance with the laws of Victoria.
